(hereinafter "Aldagi"/the "Company") is a licensed insurance company established in accordance with the Georgian laws, with identification code 404476189, registered office located at N66a, Davit Agmashenebeli alley, Saburtalo District, Tbilisi, Georgia; contact details: Tel. +995 322 444 999.

Definitions

AS used herein, the following terms shall have the following meanings:

Web-site – web-site with the following domain https://aldagi.ge/

Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;

Aldagi/Company/Controller - the joint-stock company "Insurance Company Aldagi" registered in accordance with the Georgian laws (identification code - 404476189, registered office located at N66a, Davit Agmashenebeli alley, Saburtalo District, Tbilisi, Georgia), which alone or jointly with the processor determines the purposes and means of data processing, performs data processing directly or through a processor;

Processor - means a natural or legal person, public authority, agency or other body which processes personal data  for Aldagi and on its behalf. A natural person being in an employment relationship with Aldagi shall not be regarded as a processor;

Data processing -  any operation which is performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;                                                                                                                                       

Legislation - valid legislative and by-law normative acts of Georgia;

Group companies - JSC Tao Insurance Company (I/N 202408386), JSC Insurance Company Imedi L (I/N 204919008), JSC Greenway Georgia (I/N 404867006), Amboli LLC (I/N 216402701) and those companies the direct or indirect owner of 50% or more shares of which is JSC "Georgian Capital" (I/N 404549690).

Data subject is the individual the personal data relates to;

"We", "Our" - JSC "Aldag Insurance Company";

"You", "Your" - a natural person whose personal data is processed by "Aldagi";

Personal Data Processing Policy, Its Purpose and Scope

A fundamental value for JSC "Insurance Company Aldagi" is the protection of human rights and freedoms, including privacy and personal data of individuals, respectively, during the processing of your personal data as an individual in the "Company", the compliance of the process with the applicable legislation of Georgia is strictly controlled - the data is processed fairly and legally, only for specific, clearly defined legal purposes, and the database is protected from illegal access and use.

The purpose of this policy is to provide interested parties with the opportunity to receive information about the manner of processing personal data by "Aldagi", as well as the compliance of the "Company" with the applicable legislation of Georgia and data security rules in the process of processing personal data.

When processing your data, "Aldagi" is guided by the domestic legislation of the country and the international acts ratified by Georgia, as well as by the internal documents (procedures) developed by the company and this "Personal Data Protection Policy" (hereinafter the "Privacy Policy", "Policy"), the purpose of which is to determine the appropriate rule for the protection of your personal data by "Aldagi" and to control its implementation.

This "Privacy Policy" fully applies to the processing of personal data by "Aldagi" using automated, semi-automated or non-automated means to "Aldagi" as the controller of personal data, to all employees of the "Company" who participate in data processing, to you, whose data is processed by "Aldagi", to the recipient of data to whom your personal data was transferred from "Aldagi" and to those processors who process personal data for "Aldagi" or on its behalf.                                                                                                                                   

Basics and Principles Related to Data Processing

In the "Company" your personal data is processed only if there is a relevant basis. During data processing, there may be one or several grounds at the same time.                                                                                                                        

1. “Aldagi” processes personal data of users only if and to the extent that at least one of the following applies:

• the data subject has given consent to the processing of his or her personal data for one or more specific purposes, which may be expressed both in writing and orally, in telecommunication, electronic or other relevant form;
• data processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract;
• data processing is necessary for compliance with the law;
• data processing is necessary for "Aldagi" to fulfill the duties assigned to it by law;
• data is publicly available according to legislation or the data subject has made it publicly available;
• data processing is necessary in order to protect the vital interests of the data subject or of another natural person;
• data processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;
• data processing is necessary for the purposes of the legitimate interests pursued by "Aldagi" or a or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data (in particular where the data subject is a child;
• data processing is necessary to protect important public interest in accordance with the law;
• data processing is necessary to consider the application of the data subject and to provide services to it.

2. "Aldagi" processes your special category data only under the conditions that it provides guarantees for the protection of your rights and interests provided by the Georgian legislation and there is a written consent of the data subject to the processing of special category data for one or more specific purposes.

Furthermore, your special data can be processed by us if their processing is directly and specifically regulated by law and their processing is a necessary and proportionate measure in a democratic society, as well as if their processing is necessary to d=safeguard your or another person's vital interests and in other cases provided for by law.

3.  Principles of processing your personal data

“Aldagi” processes personal data strictly in accordance with the following principles, regardless of the basis of data processing, so the personal data shall be:                                                                                                                  

• processed lawfully, fairly and in a transparent manner in relation to you;
• collected for specified, explicit and legitimate purposes;
• adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
• accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay ;           
• kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed. After achieving the purpose for which the data is processed, they will be blocked, deleted or destroyed or stored in a form that excludes the identification of a person, unless otherwise established by law.

Personal data category

When performing our activities, we mainly process your following personal data:

Identifiable data: name, surname, gender, date of birth, place, type of identity document, its data, photograph, personal number, signature, citizenship - country of residence, actual and registration address;

Contact data: phone number, personal and official e-mail address, actual and registration address;

Other information: marital status, data of family members, information on the death of a person and related documentation, activity/profession, income, workplace, position. Bank account number, technical passport, motor vehicle make, model, year of manufacture, state number, identification number, information about the insured/insured object, driver's license series, type, number, date of issue, video image, date and description of the insured event, loss caused Amount, IP address, which is used on websites belonging to Aldagi, where the services offered to you are sold, cookie files, application logs, IMEI code, data about your actions on the website, information about your location. Furthermore, in order to provide relevant insurance services in relation to specific insurance products, such as life and critical illness insurance, travel insurance, Aldagi may also request and process special personal data from you related to your health, physical condition, including: height, weight, presence of symptoms related to specific diseases, past/existing diseases, drug/alcohol use (frequency), as well as information about the services provided to you by Aldagi and the products you received from Aldagi, the data obtained as a result of communication with you and any other information, the processing of which Aldagi is obliged by law.                                                                                                                                                            

In addition to the above, taking into account the specifics of a particular case (including insurance), Aldagi may request from you other information containing your personal data, including special category data.

Video Surveillance: Aldagi carries out video monitoring of the premises under its ownership. The need for video monitoring in the mentioned areas is due to the purpose of Aldagi's security, safeguarding its property and confidential information, as well as its each employee, or any person available in the building. Through electronic devices, "Aldagi" carries out visual monitoring of space, event, activity, person. Video surveillance is carried out both on the external perimeter of the building, as well as in the entrance of the building, in the corridor, open space and meeting rooms, as well as in exceptional cases - in workplaces.

Thus, Aldagi processes your personal data during video monitoring for the above-mentioned purposes. In addition, video recordings are stored for a period of 90 (ninety) calendar days.

Purpose of personal data processing

Aldagi may process your personal data for various purposes, and the personal data should only be collected for specified, explicit, and legitimate purposes. In addition, personal data obtained for a specific purpose in "Aldagi" shall not be further processed in a manner that is incompatible with those purposes, except for the exceptions provided by the law. In "Company" your data is processed only to the extent necessary to achieve the legitimate purpose and only for the period necessary to achieve the purpose of data processing.

Aldagi may process your personal data for the following purposes (the list below is not exhaustive):

1. to provide you with insurance services;
2. to offer insurance services, implementing direct marketing, improving services, and for the purposes of monitoring your obligations;
3. to collect information about your visit to the website, including to study your behavior on the website, to remember the choices you made, to analyze the information you searched for, and to subsequently implement customized/personalized offers for you;
4. to respond to the messages left to us through different means of communication available on the website; to send you messages/correspondence as needed;
5. to update and change the personal data kept about you in "Aldagi";
6. to introduce news about the "Company", to offer various "Benefits" (additional benefits);
7. to determine the insurance event, to determine its scope;
8. to adjust the loss resulting from an insurance event;
9. to issue insurance compensation;
10. to exercise the insurer's right of subrogation;
11. to carry out insurance activities through agents and brokers;
12. to provide health insurance for employees and their family members;
13. to fulfill the obligations imposed by the law by the person responsible for data processing as the founder of the non-state pension scheme;
14. to fulfill the obligation imposed by the legislation - for the identification of the client, third party, authorized person; for the prevention and control of money laundering, fraud and other crimes;
15. to carry out research, to prepare reports/reports for various purposes determined by us;
16. to provide auto auction services to customers;
17. to sign various contracts during the company's business activities;
18. to fulfill the rights and duties assumed within the framework of contractual relations;
19. to consider and respond to complaints/complaints;
20. to provide access to data for our supervisory body and auditing companies;
21. to fulfill the obligations stipulated by the legislation;
22. If you are a candidate for employment or an employee at Aldagi, your personal data may be processed for the following purposes:
    • Attracting and selecting qualified personnel;
    • Signing the employment contract;
    • Fulfilling the obligations stipulated by the employment contract and Georgian legislation;

Obtaining personal data from third parties

ALDAGI may request and obtain personal data of data subjects from third parties in the cases defined by the legislation of Georgia, in order to fulfill the obligations imposed on "Aldagi" by the legislation of Georgia and to provide services to the data subject, as well as to carry out direct marketing in the event that third parties obtain consent from the data subject to transfer the data to "Aldagi" for the stated purpose. The third party obtaining such consent is responsible for the completeness of the consent received from the data subject and compliance with the Law of Georgia "On Personal Data Protection". ALDAGI may also obtain personal data to exercise contractual rights and fulfill obligations arising from agreements concluded with third parties, including state organizations. Such agreements may be signed with such parties as, for example: Ministry of Internal Affairs Service Agency, State Services Development Agency, National Statistics Office of Georgia, group companies, etc..

In addition, "Aldagi" obtains personal data of users based on publicly available sources (including social networks, through public information in the public register), as well as from the information kept in the group companies.

Transfer of personal data to third parties

"Aldagi" undertakes to maintain the confidentiality and security of any information received from the user. However, the aforementioned limitation on confidentiality does not apply to information or disclosure of information: which was known to the "Company" without violating the law before the relevant information was provided to it by the user, the user made it public himself and/or which can be obtained from other sources; If information is disclosed by "Aldagi" in order to comply with and comply with the requirements of the law (including any court (including arbitration) to exercise its rights); furthermore, if the information is disclosed to a third party a) on the basis of a written agreement signed between "Aldagi" and the user, in which case the party providing the information is fully responsible for protecting the confidentiality of the information provided by the third party, b) the information is transferred to the group companies, or c) when information is transferred based on the agreement concluded between "Aldagi" and the third party and the Company takes all the necessary measures to ensure that the said information is kept confidential by the third party.

The user declares his/her consent that "Aldagi" is entitled, without the additional, prior or subsequent consent or acceptance of the client, to transfer the personal data obtained on the client: to law enforcement authorities or another person, for the purpose of preventing damage and/or its settlement and compensation, as well as in the field of public interest defined by law to perform the included tasks (including crime prevention, crime investigation, criminal prosecution, administration of justice, etc.); to any local state organizations/services, in order to fulfill the requirements defined by the legislation; to the company of the group, in order to provide any service to the customer. In such a case, any company of the group shall use the user's personal data for the period established by law or for the period necessary for the purposes of data processing and ensure the safe storage of the data.

"Aldagi" is further entitled to transfer the user's personal data to any third party that provides services to it and/or group companies, in order to provide services to the user, as well as to carry out direct marketing and transfer/offer various "benefits" (additional benefits) to the user.

Data Processing through a Controller

Another person (natural or legal) processes your personal data for or on behalf of Aldagi, only if Aldagi has signed an appropriate written agreement with the processor. Prior to signing the agreement, "Aldagi" always makes sure of the reliability of the party in advance, and the agreement stipulates the obligation of the person authorized to process, to ensure such organizational and technical measures that will protect your data, and after signing the agreement, it monitors the process of fulfilling its obligations by the processor and in some cases Aldagi, through its representatives, inspects the workplace of the processor, where the processing of your personal data is carried out, and carries out on-site inspections to check the measures taken for data security. The agreements signed between "Aldagi" and the processor provide for sanctions for violation of data security obligations.   

Data Security

"Aldagi" has adopted such organizational and technical measures that ensure the protection of your data in the "company" from unauthorized, accidental or illegal acquisition, loss, destruction and/or damage, change, disclosure, illegal use in any other form.                                                                                                                             

"Aldagi"  strictly maintains the privacy of your personal data. Only those employees who need to process the data to perform their duties have access to them. The documentation in material form is stored in a specially designated room, the security of which is ensured by the technical and organizational security measures adopted by the "Company", while the access to the electronic database is protected and can be entered only by an authorized person through a user name and password. All employees who have access to information have signed a written privacy clause, which applies even after the termination of the employment contract signed therewith.                                                                                                                                                                               

In "Aldagi" the compliance of your data processing process with the legislation, internal documents (procedures) developed by the "Company" and this "Privacy Policy" is controlled by the personal data protection officer, who in case of violation of the requirements takes appropriate measures to eliminate the violation and apply sanctions. For the avoidance of doubt, when moving from the website to another link provided by the user, Aldag is not responsible for the protection of personal data of users and their security by the redirected websites.

Your Rights as the Data Subject 

You, as the data subject, have the opportunity to exercise all rights granted by law, including:

• Right of access by the data subject

You are entitled to obtain from the controller confirmation as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and the following information free of charge upon request:

1. a) about you regarding the data that is processed, as well as the basis and purpose of this data processing;
2. b) about the source of data collection/retrieval;
3. c) about the period (time) of data storage, and if it is impossible to determine a specific period, about the criteria for determining the period;
4. d) about the data subject's rights provided for in this chapter;
5. e) about the legal basis and purposes of data transfer, as well as appropriate data protection guarantees, if the data is transferred to another state or international organization;
6. f) about the identity of the data recipient or the categories of data recipients, including information about the basis and purpose of data transfer, if the data is transferred to a third party;
7. g) about automated processing, including the decision made as a result of profiling and the logic used to make such a decision, as well as its impact on data processing and the expected/probable result of processing.

• Right to access and receive a copy of the data

You, as a data subject, have the right to access the personal data held about you by us and the processor, and to receive copies of this data free of charge, except for exceptions provided by law.

• Right to correct, update and complete data

You have the right to ask us and the processor to correct, update and/or complete any incorrect, inaccurate and/or incomplete data about you.

• Right to stop data processing, or delete or destroy data

You have the right to request that we and the processor stop processing, delete or destroy data about you (including profiling).

• Right to block data

You, as a data subject, have the right to request that we and the processor be blocked if where one of the following applies:                                                                                                                                                                 

1. a) the accuracy of the personal data is contested by the data subject;
2. b) the processing is unlawful and the data subject opposes the erasure of the personal data and requests the blocking of their use instead;
3. c) the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
4. d) you have requested the termination, deletion or destruction of data processing and this request is pending;
5. e) there is a need to store data for evidence.

 

• Automated individual decision-making and related rights

You have the right not to be subject to a decision made solely by automated means, including profiling, that produces a legal or other material consequence for you, except as provided by law.

• Right to Withdrawal of Consent

You have the right to withdraw your consent to the processing of personal data at any time without any explanation or justification. In this case, in accordance with your request, we will stop processing the data and/or delete or destroy the processed data within the time limits established by law, unless there are other grounds for data processing. Furthermore, withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.

You/the data subject is also entitled:

• to request information about the processing of data about you, in particular, which data about you is processed, the purpose of data processing; Legal basis for data processing; how the data was collected; to whom the data about you was provided (the provision of information is not mandatory, if the data is public according to the law), the basis and purpose of providing the data.
• to request the person responsible for data processing to correct, update, add, block, delete or destroy data if they are incomplete, inaccurate, not updated or if their collection and processing was carried out against the law;
• at any time, without explanation, refuse to give your consent and request the termination of data processing and/or the destruction of the processed data;
• in case of violation of the rights stipulated by the Georgian law "On Personal Data Protection", to apply to the Personal Data Protection Service or the court in accordance with the procedure established by the Georgian laws;

The above-mentioned rights are not absolute and may be limited in cases provided by law.

Accordingly, you consent to the transfer of your personal (including, if any, special category) data by "Aldagi" to Aldagi's partner, specialized service provider company registered in another state ((information about which is provided in the insurance policy) hereinafter the "Assistant Company"), which is not included in the list of countries with appropriate personal data protection guarantees defined by Order 23 of the Head of the Personal Data Protection Service and, accordingly, the personal data protection standards and guarantees in the said state does not comply with the requirements established by the legislation of Georgia. However, "Aldagi" confirms that based on the agreement signed between it and the Assistant Company, they provide appropriate data protection guarantees and undertake to take the necessary organizational and technical measures for safe data transfer.

Consent to personal data processing when leaving lead/contact details

By submitting a lead/your personal information, including contact information, for us to contact you, you agree that:

Withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
